Legal Question in Real Estate Law in India

we have a house in delhi which is my fathers name but he died in last December. We are two brothers and one sister, me and my sister wants to transfer papers to my mothers name but my elder brother don�t want to sign. Even also won�t agree to distribute property in 4 equal parts. Please do let me know if possible that all property can go to my mothers name as my sister (married) and me both are agree to give her property or can we all get equal parts of property if my elder broth is not agree to sign in the distribution papers?

Dear Sir / Madam,

With the demise of your father, the property vests in the sole name of your mother and you should complete the necessary formalities for transfer of the property in her name in the record of the Tehsildar / District Registrar.

Yes, it can be distribute between four parts through law.
