Legal Question in Real Estate Law in India
My husband and I bought land in the year 1994, and started a school for orphans, under priVeleged children etc. in the year 1995. Forming a Society and getting FCRA clearance to house, educate, feed and clothe tribal children, in Salem, Attur Taluk, Salem DT.
We had around 5.25 acres patta land, 2.5 acres ReVenue land. In the year 2007, we donated 1.9 acres patta land, to the Society, and in the year 2010 we resigned.
When we tried to sell the remaining property which belonged to us, that is 3.35 acres, they stopped the sale, by saying we were trying to sell their land. They also, made a police complaint, and gaVe a public notice in the tamil newspaper, and sent official letters to GoVt. offices.
They are presently occupying other lands, and haVe not made patta transfer to their name on the land that has been gifted, claiming additional land and building area, which is on my patta land.
Please let me know if I can cancel the Dhana settlement b'cos
-they haVe not accepted the land and transferred it to their name
-they haVe not fulfilled the conditions Viz. school purpose
-seVen years haVe elapsed, and they are disputing the gift deed on Various counts
Please AdVise the right course of action, and how much time it will take to do the cancellation/ReVocation of land gift deed.

once a gift deed is made and the same is accepted by the donee then the process of gift is complete. not transferring the property in their name is not a disqualification if they have done other acts to show their acceptance.you may agitate your case in the court in respect of their taking your land and constructing on your building.
