Legal Question in Real Estate Law in India
A land measuring 26570 square meter over which a big structure is existing has been sell by the owner to another person with the land papers showing only land and not the structure over it thus undervalue the property and evade the stamp duty. My question is whether the proprietor can sell the land underneath independent of the superstructure over it?

Dear Sir / Madam,
It is possible to sell a structure built on the land by the seller retaining the rights on the land, but the converse can never be true.
