Legal Question in Real Estate Law in India

I currently live in USA but own a property in India and have been allowing my nephew to live there with no rent - he was just to pay maintenance and taxes. Now, I am in need to sell b/c I need $$. I have offered to buy him a smaller flat so he and his family have a home. However, he will not leave the flat to allow the sale. Furthermore, he has not paid taxes for the last 10 years b/c he says that it is not his house.

Where does this leave me? Is he a squatter now? What rights do I have anymore?
