Legal Question in Real Estate Law in India

Lower Court has passed the judgement for auction of ancestral property on the ground that disputed land is not square & no. of parties are 4 ...

Presently as a party ... we have just received the copy of final judgement given by lower court ... on August 23, 2013 & we received copy through our advocate on September 10, 2013.

No Authority is appointed so far, neither notice has been served so far by any the respected court.

Please advise ... the procedure now that shall take place in execution of auction process (ie. to be initiated & completed) ... and approximate time we are left with to take further remedy ...

I am really thankful to the LAW GURU website for being so quick responsive.

Dear Sir / Madam,

You can appeal against the order of the lower Court to auction the property. The Court decision to auction the property applies with immediate effect, you will have to plead the time factor for relocation to an alternative accommodation.
