Legal Question in Real Estate Law in India

I m made to understand that "if the possession of the suit property is NOT in the hands of the Benamidar & in case the possession & occupation of the suit property is with the real owner , then Benami Act of 1988 will not apply, because the Benami Act (1988) nowhere says that if the possession of the suit property is already with the real owner then the same be snatched from the real owner and given to the Benamidar"

Is the same correct?
