Legal Question in Real Estate Law in India

I was married in 2001 and I was 17 years old at that time. My husband passed away in a car accident within 10 months of our marriage and I had a daughter from this marriage. I was too young to bear all this, so I started staying with my parents because I was not courageous enough to face this situation in this society as well as take care of my daughter.

In my husband's family, I have a mother-in-aw, father-in-law, a brother-in-law and two sister-in-laws. My elder sister-in-law was married in 1989 and the other sister-in-law was married in 1999. My brother-in-law was married in 1997. Soon after my husband's death, my in-laws family started to ignore me and my daughter and they even took my husband's life insurance policy as the nominee was my in-laws ( he had not changed the nominee soon after our marriage). All the property was hard-earned by my in-laws.But my brother-in-law doesn't want to give the share in the property for my daughter. There was only one half of the plot on my husbands name and the other half of the plot was my in-laws name. Now in 2017, they have started constructing a building in the other half (which was on my in-laws name, now they have transferred the property to my co-sister) leaving the other half of the plot. There are many other plots and rental properties which they are owning . But, doesn't my daughter have any rights on it. I feel very bad as a mother , she didn't have the joy to be with her father, at least I want to her to have the rights to the properties. What can I do as a mother? How can I get the rights for my daughter?

You have faced a lot. But now stand for your right and right of your daughter. Law help those who stand and fight for their right.so for insurance of your husband, you and your daughter have ever right to have your share. Being nominee your father in law had merely have the right to receive money and to distribute the same to you, your daughter. You have every right to retain the property of your late husband so firstly take possession of plot of your husband.
