Legal Question in Real Estate Law in India
We had a non ancestral property in my mother name she died without any will , Myself and my brother signed relinquishment deed (registered) in our father name , now i took care of our father when he was ill so he GIFTED (registered) the property to me.
My brother and i live in same house me on ground he on first floor.
I want to( EVICT ) him from the house legally as our relations have sour.
HOW CAN I DO IT AND WHAT IS THE PROCEDURE FOR EVICTING MY BROTHER FROM PROPERTY.

Since the title of the property vests in your father, he is the sole authority to decide on its ownership.

Since you have already received the property through a registered gift deed, you can get an notice issued from a lawyer for evicting the property. if your brother fails to evict the house then you can file a suit for eviction and mesne profits.
