Legal Question in Real Estate Law in India

i had paid for an appartment 10 years ago to the builder. One cheque was given from a joint account between me and my sister.Since i work abroad my sister took possesion of the appartment and have now rented it out. I have the original agreement with me but it is not registered. The builder is refusing to register the agreement saying that he wants a court order to register the appt? My sister is refusing to move out the tenants form the appartment?? How can i solve this issue and legally get theappt registered including the possesion?? pls advice
