Legal Question in Real Estate Law in
My parents have been staying in Kerala for the last 4-5 years taking care of my grandmother (Dad's mother) in our ancestral house. From my dad's side they are 6 males and 3 females. My grandfather had divided the share of the land among the brothers and my dad had the house and some land around it.
Couple of years ago the property was decided to be sold off to my aunt (NRI from UK) who had agreed to give shares to each of the brothers. The share ensured for my dad was 6 lacs. All brothers signed on the agreement before receiving the money (though claiming they received money). Further to which my dad retracted and asked for more money as the house should fetch more value.
This went into a dispute and my dad returned the cheque without en-cashing. My grandmother died last month and now the aunt claims that she has already given the money and has made a police complaint to evict my parents (who live alone in the house post grandmom's death) from the house.
As we havent got any money, how do we tackle this issue and atleast get what was agreed in the first place.
