Legal Question in Real Estate Law in India

I have a property in Powai of 1500 sq mtrs sub divided into 3 parts of 500 sq mtrs each , my father had bought it in 1984 ... After loads of documentation work and many hindrances the current status is that MMRDA and BMC have given illegal permissions and documents to an encroacher during road widening in the jvlr scheme and he has developed a big hotel there .... Inspite of repeated correspondences with the MMRDA and BMC they are not responding and neither they are giving a ear to listen to the matter ..... Especially the MMRDA is being very cold with us as they are the biggest culprits ....

My question is what is the best legal action along with something more powerful to wake these officials and get the encroacher out of our property ....

Dear Sir / Madam,

If all your property papers are in order and the 7/12 utara of the property is in your name, you should file a compensation suit in the Mumbai Metropolitan Magistrate Court against Mumbai Metropolitan Road Development Authority (MMRDA) and the Brihanmumbai Municipal Corporation (BMC) for the area of land that you have lost due to encroachments thereon.
