Legal Question in Real Estate Law in India

I am to purchase a new flat which is under construction. Agreement to sale has been executed for flat No. 101 and now i want change the flat by flat No. 204. Should i cancel the banakhat of flat No. 101 and register a new banakaht for flat No. 204? or rectification in existing banakhat is possible without cancellation? What shall be the stamp duty and registration charges?

Dear Sir / Madam,

It is advisable to do the changeover in consultation and co-ordination with the Developers and adjust the price consideration for the flat No 204 is slightly more than flat No. 101 and register the revised Agreement. At the most, you may have to incur the registration cost for the revision, since the Stamp Duty has already been paid and remains unchanged.
