Legal Question in Real Estate Law in India
Hello,
We have purchased a 3BHK flat. We feel that our kitchen needs expansion from 7 feet to 8 feet in width and hence planned for moving brick wall towards drawing room, and also shifting bathroom wall towards inside by 2 feet, assuring no beam is touched. So for the same, when we asked society to permit for work, they asked for certified structural engineer certification for carrying out the necessary work. Later despite getting the necessary certificate, they rejected and said there is a rule made by the society. I want to make a note, that those individuals, had done lot of modifications, infact shifting of kitchen to bathroom area and expanding drawing room (without permission of BMC), so need to understand the law and rule. ALso, guide us that, if any, BMC permission is required?
Kindly guide us for the necessary action to take.
Thanking you,
Regards,
Dr. Sorabh Jain
1 Answer from Attorneys
1) In fact, for any deviation or modification from approved plan, BMC permission is required.
When they detect they may levy penalty or under regularization scheme.
2) If some people does then it is at their own risk and responsibility.
