Legal Question in Real Estate Law in India
Thanks for your reply confirming that I can sell the HUF property as Kartha making my both sons as vendors. Now the problem I have are the following,
1. The New house I am buying, I have to register in my name only as the banks are not accepting to give housing loan if my Minor sons ( one 19 years and the 2nd 17 years) are the buyers of the new house.
2. What will happen to the capital gains & how do I use the amounts that are given by the buyer to my sons if they are not the buyers of the new house. I need the entire amount + additional amount for buying the new house.
3. How to get a clearance to move forward in this transaction. I read in Law guru that I can get an approval from the court and complete this transaction. My wife and children are to keen to get this new house.
