Legal Question in Real Estate Law in India
Hello Sir, I have done the Agreement to Sale for a 2-BHK flat at Pune (India) by paying Rs. 3 Lakh to the Owner and by paying approx. Rs. 2 Lakh as a Stamp Duty and Registration fees. I have got the homeloan sanction from HDFC and for disbursement, bank is asking for Occupancy Certificate. I checked with Owner as well as Builder, but they don't have this certificate. In this case, if I want to cancel the deal, the owner is willing to pay me back Rs. 3 Lakh; but I would like to know what happens to the Rs. 2 Lakh I paid towards Stamp Duty and Registration. Is this amount recoverable by any means. Thank you.

Any amount paid towards Stamp Duty and registration is non-refundable.
