Legal Question in Real Estate Law in India

hello sir, myself krishna, my uncle has purchased the flat in chembur-mumbai, the builder freezed the work of construction from last 1 year, my uncle want the money back, the builder only giving the cheque, but all the cheque's are getting bounce, my uncle is a senior citizen now my uncle worring whether he will get the money back or not, what are the legal way of getting the money back, any help will be very much appreciated

Dear Krishna,

Today is Chatrapati Shivaji Maharaj Jayanti !!

Take a fresh cheque from the Builder for the return of the amount and deposit it. Should the cheque bounce, you will need to lodge a case within 30 days of the cheque having bounced under Section 138 of the Negotiable Instruments Act for recovery of your overdues.
