Legal Question in Real Estate Law in India
Being a sister, I have given relinquishment deed (RD) to my brother in respect of my father's property in Gurgaon during May 2005 but the same was not registered. However, the Conveyance Deed for the property in favour of my brother is already done in 2011.
Now my brother behavior and relationship is not good with us and my son is asking for his share as my legal heir. Can I get back my share though the brother has done the Conveyance deed already on the basis of that unregistered RD.It has come to my notice that my brother is selling the said property. Pl advice.

as the relinquishment deed has remained unregistered, it may go in your favour. You may consult a lawyer and after thorough legal research, you may file a suit for partition. However, you need to be cautious as u executed an RD.
