Legal Question in Real Estate Law in India
My Uncle(Taya ji) sold his factory land (which he got in inheritance) to my mom in 1995-96. Registry and all documents are in name of my mom. In registry it is clearly mention by my uncle that "Me and any member of my family have not any concern to this land now". My dad and uncle were jointly operating a workshop of manufacturing cycle parts on same land (Firm Closed now). My uncle is no more now and his son is not ready to leave that land and asking for his share stating that my father was partner in firm. We ask him he was partner in firm not in land and firm is closed now. Land is in name of my mom. He is using that land for his own work (some kind of rubber part manufacturing). Please update what can we do?

1) If the seller has the right and title, then issue evacuation notice to the trespasser and file FIR with police.
2) If the seller signed as partner then son also has the right. Full details required.
