Legal Question in Real Estate Law in India

Hi I am Vishwanath from Bangalore. My question is I am staying in a place from last 40 years which my father brought it. Recently it was divided it between me and my brother. I came to know that a small protion of this was not registered by my father because fo his illness and got expried. There is no record for this with my mother. My question is whether I can register in my name since it is in protion. Please help me .

Dear Vishwanath,

No, Your father had passed away intestate (without a Will) in relation to the small portion of the property, the title thereof will vest with your mother.
