Legal Question in Sexual Harassment in India

If a girl at a age 16 have a sex mutually with a man of age 24 can a case be filled after10 years under sexual assault and FIR has not been registered till now????

there are directions of the supreme court to register the FIR in any women oriented matter esp rape. The police cannot refuse the registration of the case.
