Legal Question in Sexual Harassment in India

Hi,

I worked with a MNC in noida. I was relieved from my services on charge of harassing a female colleague.

I was never provided chance to defend myself also I was not made aware of nature of complaint against me. I was forced to write on a paper, open ended statements. After repeated e-mail which included top officials of company I got following response from company:

1. That I have touched feet of employee publicly and apologied to her publicly. ( It was me who told to them and it was never publicly also it was a part of general guesture.)

2. I have send sms till late in night, and multiple time. ( I still have the copy of messages and some of the message sent by female colleague was even later than mine.)

If fare chance provided I have points which can prove that female colleague was playing double game and management representetives were biased.

Can anyone please let me know what should be right approach.

1. You should have sought advise before apologising.

2. Whether you resigned or they terminated you?

3. If no opportunity was afforded to you, and they have terminated it would be in violation of Principles of Natural Justice.

4. If you apologised in writing and admitted your 'wrong doing' then - you would not be left with any defence.
