Legal Question in Wills and Trusts in India
There appears that Will made by mother has not been made with her full consent and knowledge. it is in English, the language, she did not know, although, she could read and write Hindi.One of the share holders has managed to manipulate the same , much in his favour. He was having the Will in his custody and has approached the authorities for its registration.
Please advise, as to how to raise objection and stop its registration.

Its not necessary that Will must be in her handwriting. It may be drafted by anyone. The main thing is her signature. If it is there Will is valid in law provided it is rebutted on the ground of undue force, force, fraud or coercion.To challenge it on those ground, you need to file a civil suit.Do it now so that you can get a stay on its registration for the time being.
