We children of the deceased have been told we cannot request another member of the family to be power of attorney because she lives in America

Power of Attorney is allowed for persons outside the jurisdiction for someone in Trinidad and Tobago to apply for probate /Letters of Administration. If the applicant is in Trinidad he/she must explain why was power of attorney given (usually for serious medical condition supported by medical certificates). A person applying for probate/letters of administration signs or places a thumb print on the application where it is needed. This application must be prepared by an Attorney-at-Law once the value of the estate exceeds $ 14,500.00. and the applicant(s) basically signs or places a thumb print on the dotted lines. What can that person do that you cannot do yourself? If you and your siblings are outside the jurisdiction and the person to be given the power of attorney is Trinidadian than identify a local address. In any event, the attorney ( not to be confused with Attorney-at-Law) will have to be in Trinidad and Tobago to sign the application and any subsequent affidavits. The application by power of attorney is a bit different for probates/ letters of admin.
