Legal Question in Wills and Trusts in Trinidad and Tobago

Father died 15 years ago , mother was given everything. Mother died recently and some time in the last year youngest son had his name added to the deed with his mothers name as she was getting scenile. Now that the mother has died the youngest son is claiming ownership of the house and the rest of the children are out of the picture. There was no will. is this true

The only possible action to recovery the property is to make an application to have the deed made by your mom set aside. You will have to prove fraud or a claim of non est factum means that the signature on the deed was signed by mistake, without knowledge of its meaning.

If you are successful to set aside the deed, the children would be able to enjoy and equal share in your mom's estate
