my father had divided his ancestral and self acquired land by registered will among s son and four daughters . after his death son filled suit for partition ,in which we produced the will ,but son pleaded that father had purchased the land from ancestral land income so , he had no right to make will ,which was accepted by the court and even same decision was maintained by high court .in 15 years son did not filled decree suit because dividing the land is complicated. now i was learned that after 12 years if court order is not executed then that order nullified. now i have enough evidence to prove fathers separate ,and partision according to will is easier for daughters ,can i fill pro bet of the will or any other suit please advise me thanking u vijaya

Dear Vijaya,
Yes, you will need to Probate the Will for transfer of the title of the property to the beneficiaries named in the Will.
