There cannot be an executor if there is no will.

Your mom and Dad died 20 yrs ago and you or your siblings did nothing to administer their estates.

On the assumption the grandchild was 18 yrs old when your mom died she will now be 38 yrs old and living

in the house for 20 yrs

The issue of adverse possession may arise in this matter.

I suggest that you and/or your niece consult an attorney-at-law for a legal opinion.

Your brother is not any executor if no will exist and all the children have the same legal rights and entitlements.
