Legal Question in Wills and Trusts in India
My Father is the son of the second wife.
The Grandfather first family holds quite some property.
My father and Grandmother have been on their own from early stages of life without any support from my Grandfather as my Grandmum used to work for BHEL. Bangalore
My Grandfather passed away some 25 years back and my grand mum some 11 years back
While i was discussing with my Dad on contesting for the property. I was made aware of the existence of Will by my Great Grand father in whose these properties were first Bought.
The will is supposed to State that Property will flow only to the Male Child born out of the Wedlok of Grandfather and his first Wife and Grandfather younger brother and his Wife.
My father has not seen this will. He has heard the contents of the same from my Grand mum who had seen the will
My father has never contested for property because of the existence of such a type of will
Assuming that this will exists and was even signed by my grand father signed it along with younger brother at the time of executing the same due to the insistence of Great Grand father .
Can such a will be contested
1 Answer from Attorneys
The property is ancestral so the great grand father has no right to make such will another aspect can be you may file a suit for partition and let other party produce the will.
