Legal Question in Wills and Trusts in Trinidad and Tobago

Good day my dad died 15 years ago and my mom got his letters of administration and my mom died 10 years ago but left no will I have 3 other siblinds ,I am afraid one of them is trying to get letters of administration without us know ,is that possible for her to do or would we be informed as soon. As she applies .

There are two estates involved in this matter, your mom's and your dad's. Upon the death of your dad (intestate-no will) your mom obtained Letters of Administration. Your mom was entitled to one half of your dad's estate and the children an equal share of the remaining one half. Since you mom did not fully administrate the estate of your dad, an application of Letters of Administration de bonis non has to be done for your dad's estate. Anyone of the four children (beneficiaries) or up to all four can make this application. Your mom also has an estate of her own and Letters of Administration for her estate must also be done. Again any one, two, three or four of the children can apply. If you living in Trinidad and Tobago you can apply or give consent for your sibling(s) to apply. If you live outside Trinidad and Tobago consent is not needed from you BUT you will always be entitled to your share in the estates which now stands at one quarter. Your are entitled to request a full copy of your sister's application and you can lodge a caveat to prevent the grant until the issues raised are resolved.
