Legal Question in Wills and Trusts in Trinidad and Tobago

My sister in law is bed ridden due to a stroke (paralysis) in Trinidad and Tobago. How can my brother in law get power of attorney? She can only move her right arm / hand. My brother in law needs to access her bank account to pay bills and receive funds.

The issue is whether your sister has the mental capacity to make legal decisions. Once she has the mental capacity she can have a power of attorney executed. She can place her thumb print if she cannot sign. In this particular case the Attorney-at-Law who is preparing the power of attorney would require a certificate from a doctor indicating your sister's capacity to execute such a deed. If she lacks that capacity then your brother-in-law will be required to apply for him to be appointed the committee of his wife.
