Legal Question in Workers Comp in India
Dear Sir,
I am salaried person my last organisation hold my 45 days(from 1st DEC-2013 to 15th jan-2014 salary.on duty many time i request my employer to paying my salary but he did't anything,15 Jan i left my job with one computer hard disk,now after more then one month someone call me that someone filed FIR against me about above matter i need your advise what i should to do-?

Dear Sir / Madam,
Non receipt of your salary dues does not entitle you to take property not belonging to you while leaving the Company. You should request the Police Sub-Inspector to summon the Company HR to the Police station, convey the reason behind you taking away Company property to the concerned Police Sub-Inspector at the Police Station in the presence of the HR representative, and accept your willingness to return the computer hard disc to the Company in return for the 45 days salary owed to you by the Company. Obtain an acknowledgement from the Police station to what has been agreed.
