Legal Question in Workers Comp in India

Hi,

I was working in BPO Organisation and resigned that organisation last year.

I have met with an accident, which happened 2 years ago.

This accident had happened when I was tarvelling for night shift on office provided cab.

My shift time was 2:30 AM. I had boarded the cab by 1 AM.

I got seated in front seat. Driver and I started to reach to office.

Driver was asleep while driver and hit on the median.

My Left hip bone got dislocated and no fracture of bones.

My office took care of the expenses and hospitilised me for 21 Days and provided 8 months of leave to get recovered

Later I am diagnoised with a disease called Avascular Necrosis (AVN) which give me pain every night and will lead me to replace my left hip

This hip replacement surgery is not a permanent fix and it is to recycle every 15 years till my life cycle

Will it be possible to get compensation from employer?

Be mentally firm and strong to convince yourself that you will come out of the problem ... which is a mental block more than any physical disability.

Yes you have full right to claim the expenses of your surgery from your employer and you also have a right to claim compensation from your employer. report the incident to the police and after registration of the FIR, the insurer of the cab will also compensate you. File a MACT petition as well.You may drop in a detailed query at [email protected]
