Legal Question in Business Law in Alabama

Lease/Purchase Agreement

I entered into a lease/purchase agreement with an equipment leasing company for a spacific amount set forth by the lessor to be drafted from my business checking account. In researching my account, I find that the lessor has been overbilling my account each month above the agreed lease amount.

Also, the lessor requested verification of personal insurance which I faxed to them upon request. I was told by the lessor that the insurance information was not received and the lessor has been billing my account for insurance on the equipment.

Question:1) Do these overcharges constitute a breach of lease by the lessor?

Question:2) Is there anything I can do to end this lease and return the equipment to the lessor?

Re: Lease/Purchase Agreement

They might. I would need to see the lease agreement also.

Have you confronted the leasing company about this and demanded your money back for the overcharges? If not, do so.

I represent several businesses in disputes of this kind.
