Legal Question in Business Law in Alabama
Small business name
I bought an established business, and the name was major part of the purchase. It was a 2 year lease purchase agreement and is now paid in full. Former owner is still using business name for some transactions etc. How can I stop this?

It depends on the terms and provisions of the sales contract. If you purchased the name, then you have a right to ask the former owner to cease using it. There may also be some trademark issues, depending on the nature of the name.
If you have a right under the contract to the exclusive use of the name, you can demand that the former owner cease using it. If he or she does not, then your only recourse is to file a lawsuit for a breach of the sales contract.
