Personal Image Rights
Do I have to obtain permission from a person to publish their image as part of an ad if they are aware that 1) such a photograph exists, and 2)the possibility exists that it would be used in said advertisement?

Unless the ownership of the photograph has been effectively conveyed to you in writing, the subjct owns the image and you may not legally use it without the permission of the subject and, presumably, appropriate compensation.
