Small Claims

If I get sued by a company in small claims, but we don't go to court do i have to pay the court fee. Then if they filed in small claims and when they file the put the wrong amount on the paper which would cause the fee to be higher do i still have to pay the full fee. With that being the reason why we did't go to court anyway.

This doesn't make a LOT of sense, but let me try to help here.

You only HAVE to pay court fees when the court so orders.

If the court finds that they intentionally overstated the amount to drive up the court costs, that's a good reason for you to ask that the overage be deducted from the total, since it wasn't a charge really connected to your debt.

If you mediated the case in small claims, then you need to make sure that the agreement spells out whether you are paying court fees or not, and if so, how much.
