Legal Question in Consumer Law in Alabama
Boat purchase
We purchased a boat from a local dealer as anew boat it was inoperative on our first trip out.we found out the boat had been sold previously and returned for the same reason that we returned it. was this a legal transaction.

These types of questions are never black and white. The answer really depends on the facts; however, it sounds like a problem. Did you ask any questions about the boat before you bought it? Do you know why it was returned previously? This could be considered supression of a material fact which is tantamount to fraud. I would be glad to discuss it with you further if you have any other questions.
