Legal Question in Consumer Law in Alabama
How can get my title for a car I've paid for in full from the car dealership?
I purchased a car from a used car dealership and in July 2002 I paid the balance owed on this vehicle. Since I've paid for this vehicle the owner of the car dealership said he lost the title to my car. I've called his dealership several times and no one answers the phone. What can I do legally to obtain te title to my car?

In my opinion, when you have paid for a vehicle and not received the title, the dealership or finance company has either converted (stolen) your property or trespassed upon the same. If you decide you want to sell the car, you can't so they are asserting control over your property. Unless they have applied for a lost title certificate with the Dept. of Motor Vehicles, I think you would have a claim against them for conversion or trespass to chattels; however, the real question is: "what are your damages?" If I were you, I would write a letter to them via certified mail demanding a title within ten (10) days or evidence that they have applied for a lost title with the DMV. If no response, you will probably have to sue them. I had a similar case against a finance company. My client had paid off the finance company, but they wouldn't send her the title. I finally got her the title, and they paid my attorney fee.
