Autombile collection

When I was married to my ex-wife, we purchased an automobile jointly. When we got divorced, in the divorce degree, she was given the car and was to make the payments. The car was repossed and the payments were not made. The company that financed the loan has since sent the debt for collection by an attorney. Since as per my divorce degree, my ex-wife is to be responsible for repayment, can the attorney's office come after me for repaymet?

If you signed the contract for the purchase of the vehicle, they can pursue you for the whole debt. You, however, have a claim against your ex-wife pursuant to the divorce decree. Depending on your credit record and whether or not you care if it is damaged, I would do one of the following:

1.) pay the debt, and pursue your ex-wife under the divorce decree;

2.) offer to provide the creditor information on how they could collect from your ex-wife in exchange for their forbearance from collecting against you;

3.) let them pursue you in court, answer the complaint with a crossclaim against your ex-wife.
