Legal Question in Credit and Debt Law in Alabama
credit card fraud in marriages
Right before my ex-wife left me, she took a credit card out in my name without my permission. She ran the debt owed on it to $17,000. The card is in my name. According to the divorce decree, she is responsible for the card. She is not making the payments and my credit is being ruined. What should I do? How can I get that card out of my name?

Re: credit card fraud in marriages
If anyone (spouse, garbage man, waiter, etc) opens a card in your name without your permission, then that is identity theft. You should dispute this debt with the credit reporting agencies by filing submitting a dispute and including an identity theft fraud affidavit.
Please let me know if you need any of the forms or any help in doing this.
