Yes, absolutely. You agreed to pay the bill on time when you signed up for the card. They won't always pursue it however, unless the balance is fairly large. Usually they will just turn it over for collection and ruin your credit.

Basically, yes. You entered into an agreement with the creditor to pay all charges and interest according to a set schedule. If you fail to adhere to the agreement, the creditor can sue you in court. Of course, there are many considerations involved with that decision. If you have already been sued, I would suggest that you let an attorney take a look at your statements, agreement and account history. Some creditors, including large credit card companies, have been found to have violated federal laws related to disclosures, improper crediting of payments and any number of other violations.
