Gym Payment Agreement
My daughter was recently a student at a local gym. We signed a contract with the following payemnt agreement- ''Monthly fees are due by your first class of each month. Accounts are considered past due if payment is not received by the 10th of the month and will accrue a late fee of $10 and removal of enrollment. Any student removed from class for one month, whether voluntary or due to failure to pay, must pay a new registration fee in order to re-enroll. Withdrawal from any class requires thirty (30) days notice''.
Here is my question---The staff was told on the 17th of the month that she would not be returning. We received a bill for a the following months fees, plus a late fee. Can they charge this? Does this contract language imply that we would be responsible for a future months fees? Or should it be expressly written that a following months worth of fees will be due unless you cancel on the 1st of the month? I'm not sure if I've listed this under the correct ''Area of Law''. It's difficult to answer this question without reading the contract in its entirety. There is usually a provision that sets out the procedure to cancel such a contract. However, from what you posted it looks like the notice on the 17th is less than 30 days, thus the reason for the charge on the 1st of the following month.
