My old gym is taking me to court for $1,800!?
I recently received a phone call from my former landlord to inform me that the sheriff had come over to serve me with some papers
In October of 2007 I joined a gym with my wife. We were getting married soon and planned to move in April of 2008. The guy working at the gym told us to go with a two year membership because it was cheaper monthly, and that we would be able to cancel the contract with proof that we had moved 15 miles away from the current address. At the end of April my wife went to the gym and showed them our new electricity bill (we moved about 30 miles away). They canceled it, or so we thought.
I was never charged for anothers month membership fee, but then again, I was issued a new credit card when I moved. I was never once called by the gym, and never received any letters for collection. Just out of the blue, I was served with papers demanding that I pay for the rest of the two year contract. Total was $1800. I tried calling the gym but they wont talk to me, they want me to talk to their lawyer. So I called him. He was not interested in my story and basically rushed me off the phone when I refused to decide on apayment plan. I have to appear in court soon. What should I do? Whats the odds of me having to pay!?

you need to GO to a lawyers office and get a consultation. BRING your paperwork. There may be some condition that you have to move a certain distance (mileage) before they will cancel your membership. The terms of your contract are very important. DO NOT just take a judgment. Talk to a local lawyer IN THE COUNTY WHERE YOU ARE BEING SUED.
