Legal Question in Credit and Debt Law in Alabama

Medical bill turned over to attorney

We have a hospital bill that we are attemting to pay. However the hospital said we had to pay 100.00 per month. We can not afford that. We sent them 3 payments of 15,5,and 5 dollars more. It was then turned over to a collection agency. They said we had to pay minimum of 100.00 monthly. We sent them a 30.00 payment the first month. We then recieved a letter from an attorney saying we had to pay full amount. Can my husband's paycheck be garnished even though we are attemting to pay the bill. It is an 1100.00 bill. Are we requred to pay the minimum of 100.00 per month. Could you please explain what actions they can take legally. Thanks.

Re: Medical bill turned over to attorney

Unfortunately, you are at their mercy. Hospital bills are generally payable in full when due. However, so long as you continue to make regular payments of a reasonable amount, the attorney will not have the necessary incentive to file a lawsuit and seek the garnishment of your wages. Either way, you're going to have to pay. I recommend that you continue to pay as much as you can as quickly as you can. If it does come to a garnishment, the more you paid up front, the less that will have to be garnished.
