Legal Question in Credit and Debt Law in Alabama
Non-legitimate debt collection harrassment
A finance company sent a check to me in January that I did not ask for and did not receive. It was deposited into my checking account at a branch in another city and withdrawn three days later. At the time of the deposit I had just gotten off work 100 miles away. The first I knew about it was when they started calling demanding payment. I told them I didn't know anything about it. They said that they would send me a fraud packet. They said they sent it three times but I didn't receive it until it was sent registered mail. The check had my drivers licence number but the signature was not mine. I sent them the packet, with a handwriting sample, and then heard nothing until they started calling demanding money again. They said they had denied my fraud claim because ''it was my account and I had access to it.'' They also said they had sent me a letter but, once again, I've never seen it. I'm trying, within MY convenience, to help them resolve this matter but I have multiple people calling me, sometimes a half hour apart, and I've started getting calls as early as 8:00 Sunday morning. What can I do to get them to stop harrassing me and my family so that I can investigate this matter?

Well, it sounds like you just need to get an attorney involved. Whether you have a claim against them under the Fair Debt Collection And Practices Act depends on several factors. I would suggest you contact an attorney and give that person all the details to see what the best course of action is.
