Legal Question in Credit and Debt Law in Alabama
Original Creditor Harassment
I owe a bank for a credit card. I want to pay it but cannot right now. I wrote a letter to them asking to cancel the card and why I could not pay them at this time. The account is still under the original creditor. They call my house at least two times a day and they have started calling my work at least two times a week. Is there anything I can do to make them, at least, stop calling my workplace? I can find all kinds of ''third party'' collection information but nothing on original creditor harassment. I have complained to the federal banking authorities and the bank keeps calling, even though I have asked them on the phone and in writing, not to.

Re: Original Creditor Harassment
The Fair Debt Collection Practices Act does not apply to original creditors but it does give us an idea about what is harassing conduct and what violates our right to privacy.
You may have a claim under state law against the bank for the calls, particularly to your work.
Feel free to email me at [email protected] if you would like to discuss this further. I've been in a trial but am back in town and would be glad to discuss this with you.
Best of luck,
