Small Claims judgment

This is more of a civil matter. but here goes. If I am sued in small claims court by a creditor, and the judgment goes in my favor in the case, can the creditors still charge off the amount that they claimed I owed them and report it to the reporting agency as a paid charge off on my credit repot.

If you win your case, then that means potentially that you do not owe the money. You can read about this in our blog at http://www.alabamaconsumerlawblog.com/2007/07/what_happens_when_you_defeat_c.html

That post is directed towards debt buyers but it is the same principle - if you get sued and you win then it normally means you "are not guilty".

So, if that is put on your credit report then you have some options.

If a court determined the debt invalid and not owed, then it would be inappropriate for the creditor to charge it off and report it against you. You may have a claim against the creditor for the false reporting. In addition, I suggest you dispute this reported information on your credit report.
