Legal Question in Credit and Debt Law in Alabama

Small Claims Law Suit

I just received a summons for a debt I didn't pay because I never received a bill. The attorney that is suing says that all correspondence was sent to the wrong address but the have already summonsed me to court and they are not willing to work with me. I need to send a letter and file it with the court but I don't know what format to use, how to show that I tried to pay the bill but the company said I did not owe anything, how to show that I did not receive any correspondence because it went to the wrong address.

Re: Small Claims Law Suit

You need to consult with a lawyer and get your answer filed timely. Depending on the counts in the suit against you, you may have certain defenses that need to be raised in your answer. In addition, you do not indicate if you are being sued by the origianl creditor, a debt buyer or collection agency. Many times we see these types of Plaintiffs sue a debtor without proper proof being offered at trial to show that you owe the debt. For these reasons I urge you to consult a lawyer.
