I am threatened by a local check cashing company with a lawsuit seeking reparations as "holders in due course". They cashed a check at 9am for someone whom I had made the check to. However, I did initiate a stopped payment at 1 pm later that afternoon when I realize post hoc that the person to whom I wrote the check never intended to return to my home to complete the work for which he was paid for. The check cashing company never bothered to check with me or my bank as to whether there might be problems in getting the check paid. Would a court really award them judgement against me even though I was only trying to protect myself against fraud? The amount involved is $500. Should I pay the check cashing company or contest the claim in court?
