Legal Question in Credit and Debt Law in Alabama
I am getting threating phone calls from a person who says he works for your law firm, who claims he collecting adebt for some payday loan company named CashNet. He says if I dont comply by giving him $2496.56 to settle this debt, which he says the loan was for $400, he is going to come to Alabama and take me to jail. I need to know is this how your law firm does business? He say his name is officer ronald wilson. I need a response ASAP concerning this matter. Thank you.

I am unsure what you mean by "your law firm" but I am assuming he means that he is stating he is a "law firm" trying to collect a debt. By telling you he could take you to jail would be a major violation of the Fair Debt Collection Practices Act (FDCPA) Some debt collectors lie and say they are with a law firm, or affiliated somehow with a federal or state policing agency. There are no more "debtors prisons". Therefore, if you know the name of the collection agency he is "working" for, you may have a claim you can bring against him for a FDCPA violation.
