Re: appeals

In Alabama, capital crimes refers to crimes in which a person can receive the death penalty. Some states use the term to apply to any serious felony, and it is my impression that you are using it in that more general context.

Assuming he is in jail or prison, then he has two choices. Either his family and/or friends can hire an attorney to handle the appeal for him, or if he is in jail and indigent he can send his own Notice of Appeal to the court along with a hardship affidavit asking the court to appoint an attorney for him.

Your friend only has 42 days from the date of sentencing to file the Notice of Appeal, so if you are going to help him get an attorney you need to act quickly.

I handle appeals in criminal cases, and I would be glad to talk to you about your friend's situation. If you would like to discuss retaining me to assist him, please send me an email or give me a call on Monday.

Good luck to you.

Re: appeals

your friend will be appointed an appellate attorney if he can not afford one. He has an automatic right to appeal the conviction. I particularly do appeals and would be happy to do the appeal if he or you decide to hire an attorney. Please go to my web page and read and if I can be of service please contact me.
